Helen Ficalora Contest Rules

1) PROGRAM DESCRIPTION: No purchase necessary to enter or win. Contest begins 12:00 a.m. Pacific Standard Time (PST) on October 1, 2008 and ends at 11:59 p.m. (PST) on October 31, 2008 (“Promotion Period”). All members who signed up prior to October 1, 2008 are automatically considered eligible entries. The winner will be selected in a random drawing from among all eligible entries received.

2) HOW TO ENTER: Sign up to become a member of SomeoneSpoilMe.com and receive one (1) entry. You will receive an additional entry into the contest for every friend you have in the network. Sponsor assumes no responsibility for technical malfunctions that may occur. Information submitted by entrants will only be used to contact them with information related to the contest, unless otherwise authorized by the entrant.

3) SELECTION OF WINNER: The winner will be selected in a random drawing from among all eligible entries received online. First and second runner-up winners will be selected in the random drawing in the event SomeoneSpoilMe.com, LLC cannot reach the winner. The drawing will be conducted on or about November 1, 2008. Odds of winning depend on the number of eligible entries received. Any winner from prior Sponsor contests will be excluded from this offer.

4) PRIZE: Helen Ficalora Rose Gold Pink Ribbon Charm and 18" necklace; Approximate Retail Value (ARV): $280.; All taxes and any other costs related to the prize not specifically stated within these Rules and Regulations are the sole responsibility of the winner. The prize will be awarded and the winner will be notified by email. No substitution, cash redemption, assignment, of prize permitted. If a prize is won by a minor, it will be awarded to Parent/Legal Guardian of minor on his/her behalf.

5) ELIGIBILITY: This contest is open only to legal residents of the 50 United States and District of Columbia 18 years of age or older at the time of entry. Void where prohibited by law. Employees, directors, officers and members and their immediate families (parents, children, siblings, spouses) and household members of SomeoneSpoilMe.com, LLC are not eligible to enter.

6) GENERAL CONDITIONS: Contest entrants agree to be bound by the terms of these official rules. The laws of the United States govern this contest. All federal, state, and local laws and regulations apply. The winner will be notified via email within two (2) weeks of prize drawing. The winner (or Parent/Legal Guardian if winner is not of age of majority in State of legal residence) will be required to execute and return an Affidavit of Eligibility and Liability and, where legal, Publicity Release within 14 days following the date of issuance of notification. Non-compliance within this time period or return of the prize/prize notification as undeliverable may result in disqualification and selection of alternate winner. Acceptance of prize constitutes permission for SomeoneSpoilMe.com, LLC to use winner's name and likeness for advertising and promotional purposes without additional compensation unless prohibited by law. By entering, participants release and hold harmless SomeoneSpoilMe.com, LLC and their respective directors, officers, prize suppliers, employees, members and agents from any and all liability or any injuries, loss or damage of any kind arising from or in connection with this contest or acceptance or use of the prize won.

7) INTERNET: The use of any automated launching or entry software or any other mechanical or electronic means that permits the participant to automatically enter repeatedly is prohibited. If for any reason this contest is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this contest, the Sponsor reserves the right at their sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the contest. The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this contest. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an email address, the winning entry will be declared made by the authorized account holder of the email address submitted at time of entry. Authorized account holder is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
